Report 127: Dismissal of complaint about the ruling to reject the appeal against a verdict dismissing the action to repeal Resolution No. 4 of the Bank Extraordinary Meeting of Shareholders of 27 April 2007 on the integration of Bank Polska Kasa Opieki S.A. with Bank BPH S.A.

The Management Board of Bank Polska Kasa Opieki S.A. ("Bank") hereby informs that it received a ruling of the Warsaw Court of Appeal, dated 29 September 2009, dismissing the complaint of a Bank shareholder about the ruling to reject that shareholder's appeal against the verdict dismissing his legal action to repeal Resolution No. 4 of the Bank Extraordinary Meeting of Shareholders of 27 April 2007 on the integration of the Bank with Bank BPH S.A., carried out as the spin-off of Bank BPH S.A. by transferring a portion of BPH S.A. assets, in a form of an organised part of an enterprise, onto the Bank (spin-off by separation).
