I was kind of hoping that IM would be our Berkshire Hathaway. An asset to be sweated so that all HARL's other revenue streams could prosper without the fear of liquidation.

It appears that we live in a World where decisions made by Government Ministers are now passed to Judges, who then pass them back to Government Ministers. Who, in their right might, added this infinite spiral of expensive, time consuming, nonsense? And more importantly - how did we, the people of the United Kingdom, ever agree to it?

ForrestGump ref 14.29 post That has been the position since 1948. In a judicial review if the applicant succeeds all the court would do in most cases is quash the decision and require the decision to be retaken.

ForrestGump ref 14.41 post If these were Private Law Proceedings then you may have an argument. However, these are Administrative Law Proceedings so the position is as I said in my 14.39 post. Due to the separation of powers a Court cannot when exercising its supervisory jurisdiction making a decision for an inferior body like in this case a government minister all it can do is quash and remit back. I would refer you to the publication by the Government Legal Servce called The Judge on Your Shoulder.
